Bottle Express, Unipessoal Lda

1. Scope
These Terms and Conditions apply to all orders placed by private customers via our website www.bottleexpress.pt. The supplier is Bottle Express, Unipessoal Lda, based in Lisboa, Portugal.

2. Offer and Contract Formation
All products (beverage crates) offered on our website are non-binding. A contract is only concluded once we manually confirm your order.

3. Delivery Area and Conditions
Deliveries are made exclusively within Carvoeiro and surrounding areas.
We aim to deliver on the same day, provided your order is placed by 6:00 PM and confirmed by us. All deliveries are contactless and brought to your doorstep.

4. Products and Packaging Units
We only sell originally sealed beverage crates – no single bottles or mixed cases. All products are brand new and factory sealed.

5. Prices and VAT
All prices include the legally applicable VAT.
Please note: Different types of drinks (e.g., water, beer, soft drinks) are subject to different VAT rates under Portuguese tax law, which will be shown separately on the invoice.

6. Payment Methods
We accept the following payment methods for orders placed via our website:
• Credit and debit card payments (Visa, MasterCard, American Express)
• PayPal
• MB WAY
• Google Pay
• Bank transfer in advance
All payments must be made in advance. Orders will only be processed once payment has been successfully received and confirmed by us.
Cash payments are not accepted.
All transactions are processed securely in compliance with applicable data protection and payment security standards (e.g., PCI DSS, PSD2). Payment data is handled exclusively by the respective payment service providers and is not stored on our systems.

7. Cancellation
Cancellations are only possible on the same day as the order and only before the order is dispatched. After dispatch, cancellations are no longer possible.

8. Right of Return
Due to the perishable nature of our products (sealed food and beverages), opened crates or packaging cannot be returned under any circumstances.
Since most deliveries are made on the same day as the order, the statutory right of withdrawal (14 days) is generally excluded for perishable goods in accordance with Article 17 of the Portuguese Consumer Protection Law and Article 16 of the EU Consumer Rights Directive.
However, unopened and undamaged crates may be returned within 14 days only if:
• You notify us in writing before delivery takes place, and
• The items have not yet been dispatched.
Once delivery has been made or the products have left our warehouse, returns are no longer possible.

9. Data Protection (GDPR)
We process your personal data strictly in accordance with the General Data Protection Regulation (GDPR) and the Portuguese data protection law (Lei de Proteção de Dados Pessoais). For more details, see our Privacy Policy.

10. Dispute Resolution
We strive to resolve all issues amicably. If this is not possible, the place of jurisdiction is Lagoa, Portugal.

11. Customer Account
Customers may optionally create a personal account on our website. Account creation is not required for placing an order. You are responsible for keeping your login credentials secure. We reserve the right to suspend or delete accounts that violate our terms or remain inactive for extended periods.

12. Reviews and Ratings
Customers may leave product reviews after placing an order. We do not verify reviews for authenticity but reserve the right to remove offensive or unlawful content. By submitting a review, you grant us a non-exclusive right to display it on our website.

13. Changes to the Terms and Conditions
We reserve the right to change these Terms and Conditions at any time. Changes will be published on this website with the effective date. Orders placed before changes take effect will be subject to the Terms valid at that time.

14. Severability Clause
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Contract Language and Storage
The contract language is English.
We do not store the contract text for public access. However, you will receive a confirmation email containing the details of your order, which you may save or print for your records.

16. Input Errors and Correction Before Order Submission
Before submitting your order, you can review and modify your entries at any time on the checkout page.
Errors can be corrected using the standard functions of your device (e.g., “Back” button, or by editing the input fields).
Only when you click “Place Order” does the order become binding.

17. Delivery Charges
Orders with a total value of €25 or more are delivered free of charge.
Orders below €25 incur a flat delivery fee of €4.90.
Delivery charges will be shown during checkout before order confirmation.

18. No Sale to Minors
We do not sell to persons under 18 years of age.
By placing an order, you confirm that you are at least 18 years old. We reserve the right to request age verification upon delivery.

19. Delivery Times and Availability
We strive to deliver within our delivery area on the same day, provided the order was placed during opening hours and has been confirmed by us. Orders placed shortly before closing time will generally not be delivered until the next day.
All deliveries are subject to availability. In rare cases of high demand or supply shortages, delays may occur.
If delivery is not possible, we will notify you immediately and refund any payments already made.

21. Force Majeure

22. Applicable law and place of jurisdiction
These Terms and Conditions shall be governed by the laws of Portugal.
In the event of a legal dispute, the competent court in Lagoa (Algarve), Portugal shall have jurisdiction, unless otherwise provided by consumer protection laws.

23. Limitation of liability
To the extent permitted by law, Bottle Express , Unipessoal Lda shall not be liable for any indirect or consequential loss or damage arising from the use of this website or the supply of products.

24. Electronic Communication
You agree to receive all order confirmations, invoices and customer communications in electronic form, unless otherwise agreed.

25. Digital Security / Website Usage Rules
You must not use this website in a way that could damage, disable, or impair it, or interfere with other users’ experience. We reserve the right to block access in case of abuse or misuse.

26. Language Clause
These Terms are available in English. If translated into other languages, the English version shall prevail in case of contradictions.

27. Reservation of Ownership
All products remain the property of Bottle Express, Unipessoal Lda until full payment is made.

28. Account Suspension / Refusal of Service
We reserve the right to suspend or delete user accounts, and to refuse service, particularly in cases of fraud, abusive behavior, or violation of these Terms.

29. Technical Availability
We do not guarantee uninterrupted access to our website. Technical interruptions (e.g. for maintenance) may occur. We are not liable for temporary downtime, data loss, or delays due to technical problems.

30. Customer Obligations
Customers are responsible for providing accurate and complete information during checkout, particularly the delivery address and contact details. Costs caused by incorrect information shall be borne by the customer.

31. Promotional Vouchers / Discounts
Promotional vouchers or discount codes may only be used under the stated conditions and are not redeemable for cash. Only one code may be used per order unless explicitly stated otherwise.

32. Intellectual Property & Brand Protection
All content on this website, including product descriptions, images, logos, text, and layouts, is the intellectual property of Bottle Express, Unipessoal Lda, or licensed third parties.
Any reproduction, distribution, or unauthorized use of the content without written permission is strictly prohibited.

33. Blocking Fraudulent or Suspicious Orders
We reserve the right to refuse, cancel or delay any order if we suspect fraudulent activity, abuse of the system, or violations of our terms. This includes but is not limited to excessive use of discounts, false addresses, or chargeback patterns.

34. Dynamic Pricing Disclaimer
Prices are subject to change at any time without prior notice, especially in case of supplier price adjustments or regional availability. The price at the time of order confirmation applies.

35. Abuse of Delivery System Clause
Any abuse of the delivery system (e.g. repeated absence during delivery, fake addresses, refusal to accept products without valid reason) may result in a temporary or permanent block of the user account.

36. Reusable Crate & Deposit Policy (if applicable)
Beverage crates and containers remain the property of Bottle Express, Unipessoal Lda unless expressly sold. Loss, damage, or non-return of reusable packaging may result in a replacement fee of €[x] per item.

37. Limitation of Liability
To the extent permitted by law, Bottle Express, Unipessoal Lda shall not be liable for any damages arising from the use of our website, errors in product descriptions, delayed deliveries or temporary unavailability of the service, except in cases of willful intent or gross negligence.

38. Contractual Relationship with Final Consumers Only
Bottle Express, Unipessoal Lda sells exclusively to private individuals (end users). Any commercial resale or unauthorized distribution of our products is prohibited and may result in legal consequences.

39.Ultimate Clause: Right to Modify, Suspend or Terminate Services
Bottle Express, Unipessoal Lda reserves the right to change, restrict, suspend, or discontinue any portion of the website or service at any time and without prior notice for operational, legal, or security reasons.
This includes, but is not limited to, changes to prices, delivery areas, product availability, delivery methods, payment methods, or platform access.
Customers who have placed and paid for an order prior to such changes will continue to be entitled to the service under the terms and conditions in effect at the time of the order.
Bottle Express, Unipessoal Lda also reserves the right to deny access to the platform or terminate user accounts at its sole discretion for misuse, violation of the terms and conditions, or other valid reasons.

All product images, descriptions, availability status, and prices displayed on our website are for informational purposes only and do not constitute a legally binding offer.

Bottle Express, Unipessoal Lda reserves the right to correct errors, change offers, or discontinue products without prior notice. In the event of a discrepancy or error, we reserve the right to cancel the affected order and refund the customer the full purchase price.

41.User Conduct and Indemnification Clause
By using this website and our services, you agree to refrain from any unlawful, abusive, or inappropriate behavior, including, but not limited to, false orders, offensive communications, tampering with the ordering process, or technical malfunctions.
Bottle Express, Unipessoal Lda reserves the right to block or terminate access to anyone who violates this policy.

42.Data Integrity & System Abuse Monitoring
To ensure the security, stability, and integrity of our platform, Bottle Express, Unipessoal Lda actively monitors system interactions, traffic behavior, and transaction patterns using automated tools.
This includes detecting bots, discount code abuse, abnormal order frequency, and tampering attempts.
We reserve the right to restrict access, throttle requests, or block individual IP addresses or accounts if behavior is deemed technically abusive, legally questionable, or disruptive.
Any attempt to exploit system vulnerabilities, circumvent restrictions, or disrupt normal business operations will result in immediate termination of service and may result in legal action.

43.Right to Refuse Orders Without Justification
Bottle Express, Unipessoal Lda reserves the right to refuse or cancel orders at its sole discretion, even after confirmation, without giving any reason.
This applies in particular in cases where:
- delivery is not possible for logistical reasons,
- the order appears unusual or does not correspond to typical consumer behavior,
- technical errors or incorrect pricing have occurred,
- or customer behavior in previous transactions has been problematic.
In such cases, any payments already received will be refunded immediately and in full. No further compensation or claims will be accepted.

44. No Legal Claim to Future Availability, Discounts or Services
The use of our website, services, promotions, or prices at any time does not create any legal claim to future availability or conditions.
Bottle Express, Unipessoal Lda may change, suspend, or discontinue products, delivery areas, service levels, discounts, or features at any time without prior notice.
Customers are not entitled to compensation, replacement, or repetition of previous offers, services, or benefits, even if previously granted or advertised.

45.Severability and Survival Clause
Should any provision of these Terms and Conditions be invalid, illegal, or unenforceable for any reason, the remaining provisions shall remain unaffected.
The invalid provision shall be replaced by a valid provision that most closely approximates the economic intent of the original provision.
All disclaimers, limitations of liability, and rights granted to Bottle Express. Unipessoal Lda shall survive the termination or expiration of this agreement.

46.No Obligation to Maintain Features or Benefits
Any features, benefits, promotions, or account-related functionalities (such as loyalty programs, coupons, saved orders, or delivery preferences) are provided on a voluntary basis and may be modified, suspended, or discontinued at any time without prior notice.
There is no legal claim to the continued availability or structure of such features.
This applies even if they have been used or relied upon by the customer in the past.

47.Protection Against Copying, Reverse Engineering, and Commercial Imitation
The structure, concept, service model, ordering flow, and technical integrations of Bottle Express Lda are protected under applicable copyright and competition laws.
Any attempt to reproduce, imitate, mirror, or reverse-engineer our processes, user flows, system logic, or business identity (including branding, slogans, and delivery structure) is strictly prohibited.
We reserve the right to take legal action against individuals or entities attempting to commercially exploit or duplicate our service model without explicit written consent.

48.Third-Party Service Integration Disclaimer
Our website and services may rely on third-party technologies, platforms, or APIs (such as payment providers, geolocation tools, map services, and analytics).
Bottle Express Lda is not responsible for the availability, accuracy, or functionality of these third-party services and disclaims any liability for interruptions, errors, or data handling that result from the use of such integrations.
By using our platform, you acknowledge and accept that some features depend on the external performance and terms of these independent service providers.

49.Time-Limited Contracts & Auto-Termination
Any optional services, customer accounts, promotional programs, or special conditions provided by Bottle Express Lda are offered on a time-limited and non-binding basis.
We reserve the right to suspend or terminate such services automatically after a period of inactivity, misuse, or structural changes to our platform, without prior notification.
No legal claim shall arise from the continued availability or reactivation of such services once terminated.

50. Force majeure
Bottle Express, Unipessoal Lda is not liable for service failures or delays caused by events beyond its reasonable control (“Force Majeure”), including but not limited to:
pandemics, natural disasters, strikes, acts of war, government restrictions, power outages, transportation disruptions, system failures, or serious supplier problems.
In such cases, Bottle Express, Unipessoal Lda is entitled to temporarily or permanently suspend or terminate the affected services without compensation or prior notice.

51. Sale and delivery of alcoholic beverages
Legal Minimum Age: The sale and delivery of alcoholic beverages is strictly limited to persons who have reached the legally required minimum age. In Portugal, this minimum age is 18 years.
Altersüberprüfung: Bottle Express, Unipessoal Lda behält sich das Recht vor, bei Lieferung bzw. Übergabe einen gültigen amtlichen Lichtbildausweis (Personalausweis, Reisepass oder Führerschein) zur Altersüberprüfung anzufordern. Wird kein geeigneter Altersnachweis erbracht, wird die Lieferung alkoholischer Produkte verweigert, ohne dass ein Anspruch auf Erstattung der Lieferkosten besteht.
Order Responsibility: By placing an order, the customer confirms that they are of legal age and that no alcoholic products will be ordered or passed on to persons under 18 years of age.
Age Verification: Bottle Express, Unipessoal Lda reserves the right to request a valid government-issued photo ID (national identity card, passport, or driver’s license) for age verification upon delivery or handover. Failure to provide suitable proof of age will result in the refusal of delivery of alcoholic products, without any right to reimbursement of delivery costs.

52.Value-added tax (IVA)
Preisinformation : Alle auf der Website von Bottle Express, Unipessoal Lda angegebenen Preise sind Endpreise in Euro und enthalten – sofern nicht ausdrücklich anders angegeben – die jeweils gültige portugiesische Mehrwertsteuer (Imposto sobre o Valor Acrescentado, IVA).
Tax Rates: The amount of IVA included is determined by the tax category applicable to the respective products (currently 23% standard rate and, where applicable, reduced rates in accordance with Portuguese VAT legislation).
Separate Disclosure: The total amount shown on the invoice includes the net price of the goods, the calculated IVA, and – where applicable – shipping costs and other price components.
Changes to the Tax Rate: If statutory IVA rates change, these changes will take immediate effect for all orders placed from that point onward.
